1. Read the text ”Every crime or offence must be punished” (p.65 в учебном пособии Е.Ю. Емельяновой. И.В. Жуковой «Иностранный язык в сфере юриспруденции (английский) and answer the questions:

1) What is the most severe punishment?

The most severe punishment is imprisonment.

2) What kinds of prisons are mentioned in the text?

Maximum-security prisons, reformatories, low-security or open prisons.

3) How are inmates distributed into different kinds of prisons?

Prisoners are kept in separate institutions according to the severity of crime, age, gender and other conditions. Thus, the inmates include unconvicted prisoners, juvenile delinquents, women prisoners, recidivists and life-sentence prisoners.

4) What other punishments are described in the text?

Fine, compensation payment, probation, reparation, disqualification (for example, from driving a car).

5) What are advantages and disadvantages of fine?

Fine is the most common penalty and it has a lot of advantages. It is inexpensive to administer and does not have side effects, such as social stigma of loss of job. However, there is a danger that richer offenders can pay this fine easily, whereas less well-to-do citizens will have a heavy burden.

6) What is the idea of compensation?

Only when the offender is caught and his guilt is proved, victims of the crime will be recompensed.

7) What are the sources of compensation?

Compensation is paid by offender, or, like in some countries, the victims get compensation from public funds, whether or not the offender is detected.

8) In what cases is probation used towards criminals?

In many American states probation is combined with a suspended sentence.

9) What forms can reparation take?

Reparation means that the offender makes good the damage he has done through his crime, not by paying money but by providing services to the victim directly or indirectly. In England it takes the form of the community service order. The offender may perform up to 240 hours of unpaid work for the community. It may involve heavy physical labour or help to handicapped people.
